A 20-year-old Royal Tank Regiment Trooper was today acquitted by the Bulford Court Martial of raping a fellow service person following a night out in the Westcountry.
James Hay, instructed and assisted at trial by Allan Steele of Pury Erskine, represented the young Trooper who had always maintained that all sexual activity was consensual.
Intoxication and capacity to consent were central issues in the case.
The Crown’s case was rebutted by, amongst other things, a thorough analysis and presentation of hours of disclosed CCTV footage to shed a totally different light on the evening’s events.
