Regulatory Enforcement: Conviction Following Local Authority Investigation

Horaine prosecuted an East Sussex multi‑store off‑licence operator under the Tobacco and Related Products Regulations for supplying substantial quantities of illegal disposable electronic cigarettes.

 

The Defendant had been the subject of a lengthy investigation, which led to the discovery of a significant volume of illicit electronic cigarettes concealed in a cellar. During the trial, the Defendant contended that the items were not intended for sale but were for personal use and had remained on the premises because he intended to return them to his supplier.

 

The court found that the Defendant’s evidence during cross‑examination lacked consistency. Relying on the evidence presented on behalf of the local authority, the court was satisfied beyond reasonable doubt that the Defendant had committed the offence.

 

The Defendant was convicted and is awaiting sentence.
